Emergency Regulations
The following emergency regulations are currently in effect, having been filed by the Department of Health with the Secretary of State's Office on the date noted. The emergency regulations will be published in the State Register on the third Wednesday following the effective date. Initial emergency regulations are generally effective from the date of filing for 90 days. The same regulation may also be in the process for routine (permanent) rulemaking, with a review by the Governor's Office of Regulatory Reform or open for public comment. August 13, 2009 - Health Care Personnel Influenza Vaccination Requirements
Please note: A temporary restraining order was issued October 16 regarding the mandatory healthcare worker influenza vaccination regulation. Until this case is decided on the merits, the Department of Health can not enforce the emergency influenza regulation. This decision does not restrain a covered facility (hospital, diagnostic and treatment center, home health care agency, long term care program, hospice program) from voluntarily offering the influenza vaccines (seasonal and 2009 H1N1) to affected healthcare workers.
Further, as announced on the DOH homepage, please note that due to shortages in both seasonal and H1N1 vaccine supplies, the Commissioner has suspended the requirement in the emergency regulation that health care facilities vaccinate personnel for the 2009-2010 influenza season.
